1. Agreement to terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and Transformundo TCS LLC (“Transformundo”, “we”, “us”, “our”), regarding your access to and use of:
- The website https://elitementorshipforum.nl/; and
- Any related landing pages, media channels, and communication environments we operate.
These are collectively referred to as the “Site”.
Transformundo TCS LLC delivers the Elite Mentorship Forum (EMF) as a licensed Master Trainer for Peter Sage / MOC Consulting & Training, S.L.U. (“Team Sage”). EMF is a personal-development and transformation programme owned by Team Sage.
By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Site.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Site after changes are posted means you accept the updated Terms.
The Site is intended for users aged 18 or older. Persons under 18 are not permitted to use or register for the Site.
2. Intellectual property rights
Unless stated otherwise, the Site and all content on it, including text, graphics, logos, images, audio, video, course descriptions, layout, and design, are owned by Transformundo or used under licence from Peter Sage / MOC Consulting & Training, S.L.U. or other licensors.
All rights in the EMF programme materials, including online modules, concepts, frameworks, and programme structure, are the intellectual property of Peter Sage and Team Sage and/or their licensors and are protected by applicable intellectual-property laws.
Human Experience Architecture and Human X Architecture
Human Experience Architecture™ and Human X Architecture™ are names used by Erik Bakker in connection with original bodies of work he created. The ™ designation indicates that these names are claimed as trademarks; it does not state or imply that they are registered trademarks.
You may refer to these names where reasonably necessary to identify, discuss, review, teach about, report on, or link to the original work, provided that the reference is accurate and does not falsely suggest that you created the work or that your product, service, framework, organisation, publication, training, certification, or other activity is owned, authorised, endorsed, certified, licensed, or officially affiliated with Erik Bakker, Human Experience Architecture™, or Human X Architecture™ where no such relationship exists.
You may not use either name, or confusingly similar branding, as the name or source identifier of an unrelated commercial offering, framework, training, certification, publication, community, product, or service in a way that is likely to create confusion about origin, authorship, affiliation, sponsorship, or endorsement. Requests for permission or questions about permitted use can be sent to info@elitementorshipforum.nl.
Architecture of Experience is Erik Bakker’s publication surface for essays and open inquiry. It is not presented on this Site as one of the two trademarks identified above.
You are granted a limited, revocable, non-transferable licence to access and use the Site and to download or print a copy of content to which you have properly gained access, solely for personal, non-commercial use in connection with EMF or related services.
Except where expressly allowed, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, sublicense, sell, or otherwise exploit any part of the Site or its content for commercial purposes without prior written permission from Transformundo and, where applicable, Peter Sage / MOC.
3. User representations
By using the Site, you represent and warrant that:
- Information you submit is true, accurate, current, and complete.
- You will maintain the accuracy of that information.
- You have the legal capacity to enter into these Terms.
- You are at least 18 years old.
- You will not access the Site through automated or non-human means, except for standard browser or search-engine use.
- You will not use the Site for an illegal or unauthorised purpose.
- Your use of the Site will not violate applicable law or regulation.
If information you provide is untrue, inaccurate, incomplete, or no longer current, we may suspend or terminate access and refuse current or future use of the Site.
4. User registration
You may be required to register an account to access certain parts of the Site or EMF environment. You agree to keep your password confidential and accept responsibility for activity under your account.
We may change, reclaim, or remove a username we reasonably consider inappropriate, misleading, or offensive.
5. Prohibited activities
You may use the Site only for its intended purposes. You must not:
- Systematically retrieve Site data or content to create a database or directory without written permission.
- Trick, defraud, or mislead us or other users.
- Circumvent, disable, or interfere with security-related features.
- Use information from the Site to harass, abuse, or harm another person.
- Misuse support services or submit false reports.
- Use the Site to advertise or sell unapproved goods or services.
- Upload or transmit viruses, malware, or disruptive code.
- Use bots, scrapers, or automated systems beyond normal indexing.
- Impersonate another user or person.
- Sell or transfer a profile or account.
- Interfere with or place an unreasonable load on the Site or its systems.
- Harass, intimidate, or threaten staff, facilitators, or other users.
- Use the Site to compete with us or to replicate EMF or substantially similar protected products.
We may suspend or terminate access in response to violations.
6. User-generated contributions
The Site and related platforms may allow you to submit text, audio, video, comments, feedback, or other materials (“Contributions”). Contributions may be visible to other users or communities and may be treated as non-confidential unless explicitly stated otherwise, such as in a private coaching context.
You represent and warrant that you own or have the necessary rights to your Contributions and that they do not infringe third-party rights, violate applicable law, or contain unlawful, harmful, defamatory, discriminatory, obscene, or otherwise objectionable material.
We may edit, move, or remove Contributions that violate these Terms or that we reasonably consider inappropriate.
7. Contribution licence and media use
By posting Contributions on the Site or in EMF-related online spaces, you grant Transformundo and Team Sage a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, and use those Contributions, including your image and voice, for programme delivery, training improvement, and community support.
For promotional or advertising use of your testimonial, name, or recognisable image, we will seek specific consent where required by law or rely on written consent provided separately, such as through a testimonial or media release.
You can ask to opt out of promotional use by emailing info@elitementorshipforum.nl.
You retain ownership of your Contributions, subject to the licence granted above.
8. Guidelines for reviews
If you leave a review or testimonial, it must be based on your genuine experience and must not be defamatory, abusive, discriminatory, or submitted by a competitor acting in bad faith. We may publish, edit, or remove reviews at our discretion, subject to applicable law.
9. Third-party websites and content
The Site may link to third-party websites or resources, including EMF learning platforms, Stripe, social-media platforms, Calendly, YouTube, and other external resources.
We do not control and are not responsible for the content, policies, security, or practices of third-party websites. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
10. Payment processing
When you purchase EMF or related services through elitementorshipforum.nl, you enter into a commercial relationship with Transformundo TCS LLC, unless a different contracting entity is identified in your specific order or enrolment documents.
Payments may be processed through Stripe or another disclosed payment provider. Transformundo does not store full card details. You are responsible for ensuring that payment information is accurate and authorised.
Questions regarding billing, charges, or payment discrepancies for purchases made through the Site should be directed to info@elitementorshipforum.nl.
10.1 Paid Personal Assessment
The Personal Assessment is a 90-minute Zoom working session with Erik, priced at US$500 and paid before booking confirmation through the disclosed Calendly payment flow. The payment entity for this service is Transformundo TCS LLC.
The service includes the live session, a transcript, personalised advice and a branded direction-of-travel PDF delivered by email within five business days, subject to circumstances outside our reasonable control.
By booking, you consent to recording and transcription solely for preparation and delivery of these materials. The recording is deleted after delivery. No recording, transcript or assessment material is used publicly or for promotion without separate permission.
The US$500 assessment fee may be credited once against a new qualifying EMF Private 1:1, Fully Alive Coaching or HEA coaching package agreed directly with Erik within 90 days of the assessment. The credit is deducted from the full package price, is not transferable, has no cash value and cannot be combined with another assessment credit.
The assessment provides reflective and advisory guidance, not an absolute truth, diagnosis or guarantee of outcome. Human Experience Architecture™ may be used as an interpretive framework and is not a scientifically validated psychological or clinical assessment.
10.2 EMF cohort enrolment
The standard advertised investment for Erik Bakker’s EMF cohort route is US$6,500 unless a different fee is agreed in writing. Cohort enrolment normally uses a US$2,000 admission deposit, with any remaining balance payable under the agreed payment schedule.
After enrolment, Module 0 may be made available before the main cohort start date. Once Module 0 access has been granted, the US$2,000 admission deposit is non-refundable except to the extent mandatory consumer law requires otherwise. Specific enrolment documents may contain additional payment, timing, access, cancellation or refund conditions.
11. Refund policy
For EMF and related programmes sold through the Site, the applicable statutory cooling-off period and mandatory consumer-protection rights will be respected.
After the applicable cooling-off period, refund or cancellation requests are assessed under the specific enrolment agreement and circumstances. Costs already incurred, programme access already granted, licence or platform charges, completed sessions, administration costs, and other services already delivered may remain payable or be deducted from any agreed refund.
Any specific refund or cancellation conditions communicated at the time of purchase or set out in a signed agreement take precedence over this general summary, except where mandatory law provides otherwise.
You acknowledge that results depend on your own participation, commitment, and application of the material. No particular outcome is guaranteed.
12. Site management
We may monitor the Site for violations, take appropriate legal or technical action, remove or disable content, restrict accounts, and manage the Site to protect its proper functioning, users, and intellectual property.
13. Privacy policy
Our Privacy Policy is available at the Privacy Policy page and is incorporated into these Terms.
14. Copyright infringement
If you believe Site content infringes your copyright, email info@elitementorshipforum.nl with sufficient information for us to investigate.
15. Term and termination
These Terms remain in effect while you use the Site. We may deny access, suspend or terminate an account, or block access where reasonably necessary to protect the Site, its users, or our rights.
Programme access and participation conditions for EMF may be subject to additional written terms provided separately.
16. Modifications and interruptions
We may change, modify, or remove Site content and may suspend or discontinue parts of the Site for maintenance, security, legal, or operational reasons. We do not guarantee uninterrupted availability.
17. Governing law and jurisdiction
These Terms are governed by the laws identified in the applicable agreement and by mandatory consumer-protection rules that cannot lawfully be excluded. Where no separate agreement specifies otherwise, the parties intend the laws of the Netherlands to apply, without depriving a consumer of mandatory protections available in their country of residence.
Any dispute will be submitted to the competent court determined under applicable law. Where legally permitted, Amsterdam is the preferred venue.
18. Disclaimer
The Site is provided on an “as-is” and “as-available” basis. We do not guarantee that the Site will be error-free, uninterrupted, or that all information is complete, accurate, or current.
Participation in personal-development or transformation programmes, including EMF, involves your own choices, actions, and responsibility. We do not guarantee specific results or outcomes.
The Site and related services do not provide medical care, psychiatric treatment, psychotherapy, legal advice, or financial advice.
19. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profit, lost revenue, or data loss, arising from use of the Site.
Our total liability for claims relating to the Site will not exceed the amount you paid to us for the relevant Site access or services during the six months preceding the claim, except where applicable law does not permit such a limitation.
Nothing in these Terms limits liability that cannot legally be excluded, including liability for fraud or intentional misconduct.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Transformundo TCS LLC, its directors, officers, employees, and agents from claims, losses, or damages arising from your unlawful use of the Site, breach of these Terms, violation of third-party rights, or harmful acts toward other users or staff.
21. Electronic communications, transactions, and signatures
By visiting the Site, sending emails, submitting forms, or completing transactions, you consent to receive electronic communications and to the use of electronic agreements, records, and signatures where legally valid.
22. Miscellaneous
These Terms, together with policies, notices, and any applicable enrolment agreement, form the agreement governing your use of the Site.
If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
No partnership, employment, agency, or joint venture is created solely through use of the Site. We may assign rights and obligations where permitted by law.
